By accessing or using the BioCleaners Directory website at biocleanersdirectory.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Site. We reserve the right to update these Terms at any time. Continued use of the Site following any changes constitutes acceptance of those changes.

2. Description of Service

BioCleaners Directory is an online directory that connects individuals and businesses seeking biohazard cleanup services with service providers ("Listed Companies"). We provide a platform for discovery, comparison, and contact — we do not perform cleanup services ourselves.

3. User Accounts

3.1 Account Creation

To access certain features (such as claiming a business listing, managing a company profile, or accessing the dashboard), you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

3.3 Account Termination

We reserve the right to suspend or terminate your account at our sole discretion if we believe you have violated these Terms, engaged in fraudulent activity, or misused the platform.

4. Business Listings

4.1 Claiming a Listing

Business owners may claim their company listing on our platform. By claiming a listing, you represent that you are authorized to act on behalf of the business and that all information you provide is accurate and truthful.

4.2 Listing Content

You are solely responsible for the accuracy of your business listing, including company name, contact information, service descriptions, service areas, and certifications. Misleading, false, or deceptive information may result in removal of your listing and termination of your account.

4.3 Certifications

Companies may upload certification documents (such as IICRC, ABRA, OSHA, insurance declarations, and state licenses) for verification. Uploaded documents are reviewed by our team. We reserve the right to approve or reject certifications at our discretion. Displaying a "verified" badge indicates our review of submitted documents but does not constitute an endorsement or guarantee of the company's qualifications.

4.4 Unclaimed Listings

We may create listings for businesses based on publicly available information. If your business appears on our Site and you wish to claim, update, or remove it, please contact us or claim your listing through our platform.

5. Subscriptions and Payments

5.1 Free and Paid Tiers

We offer both free and paid subscription tiers for business listings. Free listings include basic company information. Paid tiers offer additional features such as featured placement, expanded service areas, and enhanced profiles. Specific features and pricing are described on our For Businesses page.

5.2 Payment Processing

All payments are processed securely through Stripe. By subscribing to a paid tier, you authorize us to charge your payment method on a recurring basis according to the billing cycle you select. You agree to Stripe's Terms of Service.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through your account dashboard. Upon cancellation, your paid features will remain active through the end of your current billing period. We do not offer prorated refunds for partial billing periods. If you believe you have been charged in error, please contact us within 30 days of the charge.

6. Lead Generation

6.1 For Consumers

When you submit a request for quotes, your contact information and service details are shared with up to three matching service providers in your area. By submitting a quote request, you consent to being contacted by these providers. BioCleaners Directory is not a party to any agreement between you and a service provider.

6.2 For Listed Companies

Leads are distributed based on geographic matching and other criteria. We do not charge per lead. We do not guarantee a minimum number of leads, the quality of leads, or that leads will result in business. Lead distribution is provided as a feature of your listing and is not a standalone service.

7. Reviews and User Content

7.1 Submitting Reviews

Users may submit reviews of Listed Companies. By submitting a review, you represent that your review is based on a genuine experience, is truthful and accurate, and does not contain defamatory, abusive, or illegal content.

7.2 Review Moderation

All reviews are subject to moderation before publication. We reserve the right to approve, reject, edit, or remove any review at our sole discretion. We are not obligated to publish every review submitted.

7.3 License to User Content

By submitting reviews, descriptions, images, or other content to the Site, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, display, reproduce, and distribute that content in connection with the operation of the Site and our services.

8. Prohibited Conduct

You agree not to:

• Use the Site for any illegal or unauthorized purpose
• Submit false, misleading, or fraudulent information
• Impersonate another person or business
• Harass, abuse, or threaten other users or Listed Companies
• Scrape, crawl, or use automated means to access the Site beyond what is permitted by our robots.txt
• Attempt to gain unauthorized access to accounts, systems, or data
• Interfere with the proper functioning of the Site
• Upload malicious files, viruses, or harmful code
• Use the Site to send spam or unsolicited communications

9. Disclaimer of Warranties

THE SITE AND ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or secure. We do not endorse, guarantee, or assume responsibility for the quality, safety, or legality of services provided by Listed Companies. Any reliance on Listed Companies is at your own risk.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOCLEANERS DIRECTORY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless BioCleaners Directory and its owners, officers, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorney's fees) arising out of or related to your use of the Site, violation of these Terms, or infringement of any third-party rights.

12. Intellectual Property

All content on the Site, including text, graphics, logos, icons, images, software, and the compilation thereof, is the property of BioCleaners Directory or its content suppliers and is protected by United States and international copyright laws. The BioCleaners Directory name, logo, and all related names, logos, product and service names, designs, and slogans are our trademarks or registered trademarks. You may not use them without our prior written permission.

13. Third-Party Links

The Site may contain links to third-party websites, including those of Listed Companies. These links are provided for convenience only. We do not control, endorse, or assume responsibility for the content or practices of third-party sites. Visiting any linked site is at your own risk.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved in the courts located in the State of Georgia.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BioCleaners Directory regarding your use of the Site and supersede all prior agreements and understandings.
